Duty Counsel: Family Law - Rossland Courthouse

Assists lower-income individuals who don't qualify for legal aid, with some family law issues, including providing information and helping with the preparation of Court documents.

In Provincial Court, Duty Counsel can attend court with client to:

  • Help with simple, uncontested hearings about custody, access and support;
  • Get a consent or emergency restraining order;
  • Request an adjournment

In Supreme Court cases, clients may be eligible for up to three hours of free legal advice from family duty counsel including with regard to:

  • parenting
  • child support
  • property (limited)
  • tentative settlement agreements, and
  • court procedures

Duty counsel can also assist in Chambers if the matter is: simple, unopposed, or by consent, and can also attend Judicial Case Conferences at some courts.
